The complex system for reporting and reviewing credit involves a large number of participants who fall generally into one of six categories: consumers; data repositories; data users; data furnishers; credit reporting agencies; and analytical service providers. Approximately 190-200 million consumers have credit reports maintained by the three major credit repositories (Experian, Equifax, and Trans Union) 9 . SUMMARY The Fair and Accurate Credit Transactions Act of 2003 FACT Act or Act requires the Federal Reserve Board Office of the Comptroller of the Currency Federal Deposit Insurance Corporation Office of Thrift Supervision National Credit Union Administration Securities and Exchange Commission and Federal Trade Commission in coordination with one another to adopt consistent and comparable rules regarding the proper disposal of consumer report information and records. Background The Fair and Accurate Credit Transactions Act of 2003 Pub L. 108-159 117 Stat. 1952 FACT Act or Act was signed into law on December 4 2003. In part the Act amends the Fair Credit Reporting Act FCRA 15 . 1681 et seq. by imposing a new requirement on persons who possess or maintain for a business purpose consumer information derived from consumer reports. The Act requires that any person that maintains or otherwise possesses consumer information or any compilation of consumer information derived from consumer reports for a business purpose properly dispose of any such information or compilation. 1 The FACT Act directs the Commission to consult and coordinate with other agencies in connection with promulgating rules regarding the proper disposal of consumer report information and records. Specifically the Act directs the Commission to consult and coordinate with the Federal banking agencies 2 the National Credit Union .
