South Africa's dramatic political transition was accompanied by an equally dramatic legal This legal revolution witnessed the demise of a tradition of parliamentary sovereignty and its replacement with a supreme Constitution, a Constitutional Court and broad political support for democratic constitutionalism. While South Africa's system of apartheid, or legally-constituted racism, may have been unique in the last quarter of the twentieth century, the decision to embrace democratic constitutionalism as the basic legal element of the country's political reconstruction was much less unusual | CONSTITUTING DEMOCRACY Law Globalism and South Africa s Political Reconstruction CONSTITUTING DEMOCRACY Law Globalism and South Africa s Political Reconstruction Against the backdrop of South Africa s transition from apartheid this provocative book explores the role of late twentieth century constitutionalism in facilitating political change. Using South Africa as a case study Klug s larger project is to investigate why there has been renewed faith in justiciable constitutions and democratic constitutionalism despite the widespread recognition that courts are institutionally weak lack adequate resources and are largely inaccessible to most citizens. He places this question in a broader context evaluating the appeal of different constitutional models and illustrating how globalized institutions can be adapted to serve local domestic needs. Incorporating constitutional law politics and legal history this examination of South Africa s constitution-making process provides important insights into the role of law in the transition to democracy. Heinz Klug is Assistant Professor in the Law School at the University of Wisconsin Madison and Honorary Research Associate School of Law University of the Witwaters-rand. Growing up in Durban South Africa he participated in the anti-apartheid sưuggle as a journalist and ANC activist. After eleven years in exile he returned to South Africa in 1990 teaching law at the University of the Witwatersrand. He has worked with various ANC commissions and government ministries on a range of issues including constitutional questions land affairs and water policy.
